1. General timeline

The registration process of a trademark in Ukraine takes approximately 2 years from the filing date, if no provisional refusal or opposition is issued.

The long duration is due to the substantive examination conducted by the Ukrainian IP Office (UANIPIO).
During this stage, the examiner checks for similarity with earlier trademarks (phonetic, graphic, and semantic similarity).

If the examiner finds conflicts, a provisional refusal is issued, which extends the registration period until arguments are reviewed and the decision is finalized.

At present, no fast-track procedure exists in Ukraine.

2. Main stages of registration

  1. Filing the application – submission of all required data and representation of the mark.

  2. Formal examination – verification of compliance with filing requirements and absolute grounds (distinctiveness, legality, non-descriptiveness).

  3. qualification examination – assessment of relative grounds (similarity with earlier marks).

  4. Decision issuance – acceptance or refusal.

  5. Publication in the register.

  6. Registration certificate issuance – trademark protection for 10 years, renewable indefinitely.

3. Examination details

During formal examination, experts check:

  • compliance with legal and formal filing requirements;

  • whether the mark meets absolute criteria (it must be distinctive, not descriptive, and not contrary to public order).

During qualification examination, experts analyze similarity with earlier trademarks based on:

  • phonetic similarity,

  • graphic similarity,

  • semantic (conceptual) similarity.
